It was filed locally in my temporary file. I left that Brigade and the new Sergeant Major forced my rater to put that I received a GOMAR and gave me a needs improvement on my NCOER. The GOMAR will go away in 3 years. Is that legal for it to be put on my NCOER? Can I appeal that NCOER? Do I need a lawyer to appeal this?
U.S Army Non-Rated time Questions: Military I have a question about non rated time and the Z code, I know someone who recieved an change of rater NCOER from a Rater whom rated him roughly 90 days, the pervious rater whom was on the rating chain, did not give him a change of rater or letter of continutiy for the new Rater.
They can close out the NCOER, but then if the investigation is substantiated later, they can do another NCOER, adverse, to document the underlying misconduct. Also, there are potential adverse consequences other than an NCOER--Art. 15, court-martial, letters of reprimand. Sounds its time to get help now rather than wait.

An NCOER is intended to cover the entire rating period. At some point in 12 months they failed to be a physically fit NCO. Some people would say they did improve; I would say the needs improvement would imply next rating period go the whole rating period without failing the standard.
